Former-PwC employee charged over Lux-leaks

ルクセンブルグの税務当局が、世界各国の企業と課税に関する秘密の合意を行っていたことが暴露された件は、当サイトでも取り上げましたが、その情報を漏らしたPwCの元職員がそれに関連して起訴されたという記事です。

A former employee of PwC Luxembourg has been charged in relation to leaked documents that have caused international outrage, known as the Lux-leaks scandal

ルクセンブルグの検察当局は、元PwC職員のフランス人を、窃盗、営業秘密の漏えい、マネーロンダリング、および、コンピュータシステムへの不正アクセスの罪で起訴したことを公表しました。

In a statement on Friday, the Luxembourg public prosecutor’s office said that a judge had charged Frenchman Antoine Deltour with theft, giving away business secrets, money laundering, and fraudulently accessing a computerised data system.

ルクセンブルグにも内部通報者を保護する法的枠組みがありますが、NGOやメディアに接触した従業員をカバーするものではないそうです。

While Luxembourg has an extensive legal framework to protect whistleblowers who report information, this is restricted to certain bodies and does not extend to cover employees that contact NGOs or the media. For these reasons, it is possible that Deltour will receive limited legal protection.

この元PwC職員は、PwCのデータベースから研修資料をコピーする際に問題の税務資料を発見したのだそうです。

According to reports from Business ETC, Deltour said he was “just one element in a larger movement”, and explained that he found the tax documents while copying training documents from the PwC database.

その内容にぞっとして、これといった意図や計画なしに、税務資料もコピーしたそうです。

“Without any particular intention or precise plan, I copied [the tax documents] also, because I was appalled by their content,” he said.

しかし、彼は、このような実務慣行は業界全体に広がっているのに、ルクセンブルグとPwCがこれほど多くの非難を受けるのは不公平だとも述べています。

However, Deltour went on to say that it was unfair for Luxembourg and PwC to receive so much criticism when the practices were “systemic” in the industry.

Deltour said, “It is unjust that Luxembourg is the only country being pilloried, that one auditing firm is singled out, because these practices are systemic.

“Legislation will always lag behind financial engineering.”
