ＮＢＡ元セルティクスのガーネット氏が会計士を提訴　８５億円の横領に関与？

北米プロバスケットボールの元スター選手が、会計士を訴えたという記事。別の会計士による横領を見逃したと主張しているそうです。

「ＮＢＡのティンバーウルブスとセルティクスで活躍し、２００８年にはファイナル制覇にも貢献したケビン・ガーネット氏（４２）が「総額７７００万ドル（約８５億円）の資産を使い込んだ会計士を野放しにしていた」として、ケンタッキー州在住のマイケル・ワーハイム会計士と会計事務所を相手どってミネアポリスの連邦地裁に提訴。横領したと指摘しているのは、同じくＮＢＡの元スター選手、ティム・ダンカン氏（４２＝元スパーズ）への詐欺行為で昨年に禁錮４年の刑を宣告されたチャールズ・バンクス４世会計士だが、ガーネットはなぜか同会計士は訴えていない。

訴状によれば「ワーハイム氏は、バンクス氏が使い込んでいることを知りながら何も対処しなかった」とその責任を追及。一方、ワーハイム氏はその事実を否定しており、全面的に争う構えを示している。」

バンクス４世会計士の方は、この選手の資産管理をやっていたようです。昨年、別の選手からの横領事件で、禁固4年の判決を受けています。

NBA champion Kevin Garnett has sued an accountant and his firm for allegedly helping a wealth manager defraud Garnett out of $77 million. The federal malpractice suit claims that Garnett’s accountant Michael Wertheim, and Wertheim’s firm Welenken CPAs, had knowledge that wealth manager Charles Banks IV was removing millions of dollars from Garnett’s accounts and did nothing about it.

While Banks is not named as a defendant in the lawsuit, he was sentenced to four years in federal prison last year for defrauding another NBA star, Tim Duncan, out of $6 million. Banks was acting as Duncan’s financial advisor at the time. The Star Tribune notes that Garnett’s money stopped disappearing after Banks was sentenced, according to financial records obtained by Garnett’s counsel from Welenken.

The lawsuit contends Wertheim "possessed actual knowledge that Banks was helping himself to millions of dollars of Garnett's money and did nothing about it."

"Banks intentionally ... looted Garnett of his earnings and assets for many years, including the many years that Welenken and Wertheim provided accounting services to Garnett and his business interests," according to the lawsuit, which was initially filed in Hennepin County District Court and moved Wednesday to U.S. District Court in Minneapolis.
