米HP社、Autonomy社の創業者と元CFOに51億ドルの損害賠償請求（economiaより）

HP sues Autonomy pair for $5.1bn

Hewlett Packard社が、英国のソフトウェア会社Autonomyの創業者と元CFOに対し、51億ドルの損害賠償金を求める訴訟を起こしたという記事。この２人がAutonomy社の経営を担っていた際に発生したとされる会計不正をめぐるものです。（元CFOは英国の会計士団体であるICAEWの会員）

Hewlett Packard is suing Autonomy founder Mike Lynch and its former CFO Sushovan Hussain through the London courts for damages of $5.1bn (£3.45bn) over an alleged accounting fraud that took place while the pair were in charge of the UK software group

訴えによると、この2人はAutonomy社の役員だった時に不正な活動に従事したとされています。

The claim, which was lodged in the High Court yesterday, alleges that “they engaged in fraudulent activities while executives at Autonomy”.

創業者の方も、HP社がAutonomy社の経営陣に関し虚偽で過失のある陳述を行ったとして、1億ポンド超の損害賠償を求めて反訴する予定だそうです。

In response, Lynch is understood to be on the brink of lodging a counterclaim for more than £100m in damages, alleging that HP has made “false and negligent statements” about Autonomy’s management.

Both he and ICAEW member Hussain have consistently denied any wrong-doing.

当局の捜査はどうなっているかというと、英国のSFOは、証拠不十分でAutonomy社に対する捜査を中止しています。

In January the UK Serious Fraud office announced that it was dropping its investigation into Autonomy on the basis of insufficient evidence for a realistic prospect of conviction. It added that it was ceding jurisdiction of the investigation to the US authorities.

デロイトを訴えるという話もありましたが、どうなっているのでしょうか。巨額M&Aが大失敗し、それを会計問題だといって、責任転嫁している面もありそうですが・・・。
