法と民度及び民情の関係
法は日本の民度や民情に合わせて定めるべきものである。厳密に言えば、地方や社会階層毎に民度や民情は異なるので、それに合わせて定めるべきである。
しかしながら、あまり細分化してしまうと社会が混乱するので、小さくても県単位という事になるだろう。
ところが、我が日本においては、法と民度及び民情がアンバランスである事が間々ある。その最たるものが、議会制民主主義ではないだろうか?しばしば、国政選挙の投票率が低い事を嘆き、投票率が低いのは国民の努力が足りず、意識が低いためであると言われる。しかしながら、歴史的背景の異なる欧米の政治システムを真似ても上手くいかないと考えるほうが自然ではないだろうか?
議会制民主主義は、悪い制度ではないにしても、日本には所詮お仕着せであり、また違和感を感じている人も多いのではないか。
西洋礼賛も良いが、冷静に日本の民度や民情を意識していないと悪法を国民に押し付ける事になるだろう。
Relationship between law, cultural level of people, and condition of the people
Laws should be established in accordance with Japan's people's standards and circumstances. Strictly speaking, the cultural level of the people and the people's circumstances differ depending on the region and social class, so it should be determined accordingly.
However, if area is subdivided too much, society will become chaotic, so even if it is small, it will probably be nice for a prefectural unit.
However, in Japan, there is often an imbalance between the law, cultural level, and public sentiment. Isn't parliamentary democracy the best example of this? People often lament the low voter turnout in national elections, and say that the low voter turnout is due to a lack of effort and low awareness on the part of the people. However, isn't it more natural to think that imitating the political systems of Europe and America, which have different historical backgrounds, will not work?
Although parliamentary democracy is not a bad system, Japanese is not still familiar with this, and many people may feel uncomfortable with it.
It isn't bad to praise the West, but if we are not calm and conscious of the Japanese people's cultural level and sentiments, we will end up imposing bad laws on the people.
