ブラジル国営石油、汚職の罰金967億円支払いへ

ブラジル国営石油会社ペトロブラスが、粉飾決算などの罰金として、総額8億5300万ドル（約967億円）を支払うという記事。

「ブラジル国営石油会社ペトロブラスは27日、2003年から12年にかけて行った収賄や粉飾会計などの罰金として、ブラジルと米国の検察や司法当局らに対し、総額8億5300万ドル（約967億円）を支払うと発表した。

ブラジル検察当局に80%、米司法省と米証券取引委員会にそれぞれ10%ずつ支払うことで各当局と合意した。」

請負業者からこの会社の役員へのキックバック（それを政治家と山分けしていた）が問題となっていました。

The settlement resolves U.S. investigations arising out of the corruption scandal at Petrobras that involved the payment of billions of dollars in kickbacks by contractors to company executives, who then shared the payments with Brazilian politicians.

会社は、このキックバックの金額を資産の取得や改良のための支払いに含めて会計処理していたため、有形固定資産が25億ドル（推定）も過大計上される結果となりました。

According to the U.S. Securities and Exchange Commission, Petrobras misled U.S. investors by recording the kickbacks as money spent to acquire and improve assets, resulting in an estimated $2.5 billion overstatement of property, plant and equipment in the company’s financial statements.

2010年に行われた699億ドルの株式公募（そのうち100億ドルは米国における公募）のための資料においても、資産が水増しされていました。

The assets were also inflated in materials for a $69.9 billion global public offering of Petrobras equity securities in 2010, which included approximately $10 billion in shares offered in the U.S., the SEC said.

会社は不正に支払われた金額の一部を、損害賠償金として回収しているそうです。

Through Operation Car Wash, Brazilian authorities, including the Brazilian Supreme Court, have affirmed that certain former Petrobras executives and others engaged in a corrupt scheme that harmed and caused severe financial loss to Petrobras. Petrobras has already recovered more than R$2.5 billion in restitution in Brazil and will continue to pursue available legal remedies from all culpable companies and individuals. Under these agreements, DOJ also recognizes Petrobras’s status as a victim of the embezzlement scheme and the SEC recognizes the company’s status as an Assistant to the Prosecutor in more than 50 criminal proceedings in Brazil.

「ブラジル政府はこの設備工事を含む計19のプロジェクトに関わった計20の企業や個人に対し、約2970億円の支払いを求めている。同社は証拠がないとして異議申し立てを行う。

不正の対象とされるのは、同国建設最大手オデブレヒトが同国営石油会社ペトロブラスから受注した19案件。東洋エンジの子会社は、このうち石化コンビナートの設備工事をオデブレヒトと共同受注した。」
