ラオスでの活動家拉致に関連しまして

We are writing in advance of your meeting with the prime minister of Laos, Thongsing Thammavong, at the Japan-ASEAN Summit in Tokyo in mid-December. We, NGOs in Japan, respectfully request that in your meeting with Prime Minister Thammavong that you raise the case of prominent civil society leader Sombath Somphone, who was abducted and forcibly disappeared in Vientiane by Laotian authorities on December 15, 2012. It is imperative that the Laotian government immediately provide full information on Sombath’s whereabouts or fate. We believe that if you raise this case publicly, and make clear that it is a matter of serious concern for Japan and other international donors to Laos, it will send a strong message to the Laotian leadership that urgent action on this case needs to be taken.
12月中旬に東京で開催される日本・アセアン首脳会議の際に行われる、総理とラオス首相トーンシン・タムマヴォンカン氏との会談を控え、本書簡をお送り申し上げます。私たち日本のNGO諸団体は、総理がタムマヴォンカン首相と会談する際、2012年12月15日にラオス当局によってビエンチャン市内で拉致・強制失踪させられた、著名な市民社会活動家ソンバット・ソンポン氏の事件を取り上げて頂くよう要望するものです。ソンバット氏の所在や消息に関する全ての情報を、ラオス政府は直ちに提供しなければなりません。総理が公式にその事件を取り上げ、日本が重大な懸念を抱いているのを明らかにして下されば、ラオス指導部に対し、この事件に関し早急な措置を必要としているという、強いメッセージになると思料致します。
The upcoming Japan-ASEAN Summit, scheduled from December 13 to 15, falls on the one year anniversary of the abduction of Sombath, a recipient of the Ramon Magsaysay Award for Community Leadership in 2005. He was taken into custody in front of a police checkpoint in downtown Vientiane, and has not been seen since.
12月13日から15日まで予定されている、このたびの日本・アセアン首脳会議は、2005年にラモン・マグサイサイ賞社会指導部門を授与されているソンバット氏が拉致されて、1年が経過する記念日にあたります。ソンバット氏はビエンチャン中心街にある警察の検問所の前で拘束され、以降行方不明になっています。
The facts of the case are as follows: Sombath Somphone was last seen by his wife, Ng Shui Meng, the evening of December 15, 2012 as they were driving separately from his office to their home for dinner. Shui Meng lost sight of Sombath’s jeep at around 6 p.m. near the police post on Thadeua Road (Kilometer 3) in Vientiane.
ソンバット・ソンポン氏は2012年12月15日の夜、夕食に氏の事務所から車を運転して自宅に帰る途中、別々に車を運転していた妻のン・シュウイ・ムオンに目撃されたのを最後に消息を絶ちました。シュウイ・ムオンは午後6時頃、ビエンチャン市内タードゥア通り（キロメーター3）上の警察検問所付近で、夫のジープを見失っています。
Shui Meng obtained closed-circuit television (CCTV) from the police that shows that Sombath’s jeep stopped by police at the Thadeua police post at 6:03 p.m. The police then took Sombath into the police post. Later, a motorcyclist stopped at the police post and drove off with Sombath’s jeep, leaving his own motorcycle by the roadside. Another truck with flashing lights then came and stopped at the police post. Two people got out of the truck, took Sombath into the vehicle, and then drove off.
シュウイ・ムオンは警察から、有線テレビ（CCTV)の映像を入手しました。それには、「ソンバット氏のジープが午後6時3分にタードゥアの警察検問所で、警察官によって停車させられる」、次に「警察がソンバット氏を検問所に連行する」、その後、「警察検問所に停車中のバイクに乗っていた人物が、バイクを道路脇に残し、ソンバット氏のジープを運転して走り去る」、「別のトラックがヘッドライトをまたたかせながら来て、警察検問所で停車する」、「2人の人物がトラックから降り、ソンバット氏を乗せて走り去る」というそれぞれの様子が映されていました。
Since Sombath’s disappearance, senior Laotian officials have repeatedly denied having taken him into custody or provided other information on his situation. The failure of Laotian authorities to conduct a thorough investigation into Sombath’s disappearance has heightened concerns about the Lao government’s involvement. The government has also rejected offers of external assistance from various governments, including to analyze the original CCTV footage to determine the identities of the individuals involved in Sombath’s abduction.
ソンバット氏が失踪して以降、複数のラオス高官が繰り返し、氏の拘留を否定し、氏の状況に関する情報提供を拒んで来ております。ソンバット氏失踪事件への徹底的な捜査を行わないでいるラオス当局の姿勢は、事件へのラオス政府の関与についての懸念を高めています。ラオス政府はまた、ソンバット氏拉致に関与した人物の身元を明らかにしようとする、CCTV映像の原版分析など、様々な外国政府による支援の申し出も拒否して来ました。
Enforced disappearances are defined under international law as the arrest, detention or abduction of a person by state officials or their agents followed by a refusal to acknowledge the deprivation of liberty or by concealing the fate or whereabouts of the person, placing the person outside the protection of the law. We ask that you remind Prime Minister Thammavong that the Laotian government, is obligated international human rights law to prevent and remedy any enforced disappearance. As one of the first countries in Southeast Asia to sign (though not yet ratify) the International Convention for the Protection of All Persons from Enforced Disappearance in September 2008, Laos must refrain from acts that would defeat the object and purpose of this treaty.
強制失踪は国際法上の定義によると、国当局者あるいは機関員が個人を逮捕或いは拘束したにも拘わらず、個人の自由はく奪している事実を認めず、又はその失踪者の消息や所在を隠ぺいし、失踪者を法律の保護外に置く行為を指します。総理がタムマヴォンカン首相に、ラオス政府が強制失踪を予防すると共に、救済措置をとる、国際人権法上の義務があることを、思い出させて頂けるよう、私たちは要望致します。2008年9月、東南アジア諸国で最初に「強制失踪からのすべての者の保護に関する国際条約（以下強制失踪条約）」に署名した国（批准はまだですが）として、ラオスは同条約の目的を無化する様な行為を慎まなければなりません。
One year since Sombath’s enforced disappearance, the Laotian government has failed to conduct a serious investigation. This is despite widespread regional and international calls for accountability, including from US Secretary of State John Kerry and the High Representative for Foreign Affairs and Security Policy Catherine Ashton.
ソンバット氏の強制失踪事件が起きて1年が経過し、米国国務長官ジョン・ケリー氏や、欧州連合外務・安全保障政策上級代表キャサリン・アシュトン氏を含め、周辺国や国際社会から広く説明責任を果たすよう声が上がっているにも拘わらず、ラオス当局は本格的な捜査を行っておりません。
Human Rights Watch would welcome your global leadership in sending the message to the Laotian government and other ASEAN member states that the protection of all persons in custody is a concern not only of the respective government but of the broader international community. We appreciated your leadership in February 2007 in signing the Convention against Enforced Disappearance at the signing ceremony in Paris. Raising the Sombath case with Prime Minister Thammavong would demonstrate your commitment to Japan’s “diplomacy based on the fundamental values of freedom, democracy, basic human rights, and the rule of law.”
総理がラオス政府や他のアセアン加盟国に、被拘留者全員の保護は、それぞれの政府のだけではなく、より広範囲な国際社会の懸案事項である、というメッセージを送り世界的なリーダーシップを果たして頂けることを、ヒューマン・ライツ・ウォッチは願っています。私たちは2007年2月にパリで行われた強制失踪条約署名式で、同条約に署名した総理のリーダーシップを高く評価しております。タムマヴォンカン首相との会談でソンバット氏失踪事件を取り上げて頂ければ、「日本の外交は（中略）自由、民主主義、基本的人権、法の支配といった、基本的価値に立脚し、戦略的な外交を展開していくのが基本であります」、という総理の所信表明演説への献身ぶりを示すことになるはずです。
Japan’s public silence on the Sombath case sends precisely the wrong message to the Laotian government, suggesting that its inaction is acceptable to Japan. This is damaging to Japan’s moral standing as a country that promotes rights, accountability, and the rule of law. As the biggest bilateral donor to Laos, Japan’s voice carries weight that cannot be overlooked by Lao’s leadership. Japanese development aid will only be effective when carried out with the assistance of civil society activists such as Sombath. His “disappearance” has raised serious concerns among development groups in Laos that those who raise unpleasant truths about the government may face retaliation.
ソンバット氏失踪事件に日本が公的に沈黙してしまえば、無為無策を日本は受け入れたという、まさに最悪のメッセージをラオス政府に送ることになります。それは諸権利・説明責任・法の支配を促進する国家としての道徳的地位を損ないます。ラオスへ2国間援助の最大提供国として、日本の意見はラオス指導部によって看過できない、重みを持っています。日本の開発援助は、ソンバット氏のような市民社会活動家の支援を得て実行されてこそ、効果を持つでしょう。彼の「失踪」はラオス国内で開発問題を取り扱う団体の間に、政府についての不愉快な真実を取り上げる者は、報復に遭うかもしれないという、深刻な懸念をもたらしています。
In the absence of any immediate positive response to your concerns about the Sombath case, we would ask that you and other aid donors to Laos call for an independent commission, ideally with international involvement or support, to investigate the case.
ソンバット氏失踪事件について総理が懸念を表明なさっても、それに直ちに対応がないようでしたら、総理と他のラオスへの援助提供国・機関が事件調査に向け、理想的には国際的関与あるいは支援を得た、独立委員会の設立を求めるよう、私たちは要請いたします。
We appreciate your support for raising the case of Sombath Somphone during your upcoming meeting with Prime Minister Thammavong, publicly highlighting the matter at the Japan-ASEAN summit meeting, and calling for an independent commission should the matter remain unresolved. Additionally, we hope you will work with other international donors to Laos press the Laotian government at future meetings and forums about Sombath’s case, making clear that the matter will not rest until full information is provided on Sombath’s whereabouts or fate, and that all those responsible for his enforced disappearance are brought to justice.
タムマヴォンカン首相との来るべき会談の際に、ソンバット・ソンポン氏失踪事件を取り上げ、日本・アセアン首脳会議で問題を正式に浮かび上がらせ、更に事件が未解決のままである場合には独立委員会の設立を求めることに、どうか総理のご支援を頂きますよう、よろしくお願い申し上げます。更に私たちは、総理がラオスへの他の援助国・機関と協力し、ソンバット氏失踪事件についての将来の会議やフォーラムで、ソンバット氏所在や消息に関する全ての情報が提供されると共に、氏の強制失踪に責任を有する者が全員裁判に掛けられるまで、事は静まらないということを明確にし、ラオス政府に圧力をかけて頂くことを願っています。
