この件については、契約書原文を確認出来ないので詳細記述を差し控えますが、タツノコ・プロダクション側が1985年頃「アジア各国を除く」(実際には日本語圏(日本国)を除く中華人民共和国/中華民国を始めとするアジア各国に輸出された)という条件付きで、他の2作品と共に「Harmony Gold USA.」社に著作権放棄特約で、他の国内権利者との調整の無いまま契約を為したことから、「MACROSS」、「U.N. SPACY」のロゴが米国に於いて商標権登録されました。 このことから、「権利を譲り受けた」と主張する米国ハーモニーゴールド側が、米国内での日本の同作品の「マクロス名義」作品の頒布者からライセンス料を支払う訴えを起こしたり、逆に国内での商標権登録に異議の申立てを行うものの、却下されるという決定が行われています。 これまで私の記事を読まれた皆さんは、既にお解かりかと思いますが、私は、現在までのところ、以下の両者間には、訴訟の為の代理人弁護士を通じた「敵対的な間接交流」はあったかもしれませんが、両者の利害を調整する為に双方から代表を選んで、商標権の利害調整を行う機会は、これまで設けれられていなかったと推定します。 そこで必要になるのが、交渉人と『和解又は調停』を行う委員会です。 これらの人々は、両者間の商標権が互いに衝突しないように、条件や方法、手段を契約書や調停・和解協定書の形で策定し、締結後の両者の商業的効果が最大になるように配慮しなければなりません。
