世界の「皆様」へ ルノー、日産へ経営統合申し入れ もし「ルノー」が「日産」を吸収してフランス流の経営を行うと 「日産」から人材が流失して「日産」は破産します。

世界のメディアの「皆様」　へ　

2019-04-23: 拝啓、エマニュエル・マクロン大統領は日本の「雇用制度」を参考にして「雇用革命」をおこなうべきです。
日本国は「ＢＡＣ＋３」が国や企業を動かしています。

第1部。 もし「ルノー」が「日産」を吸収してフランス流の経営を行うと
「日産」から人材が流失して「日産」は破産します。
日本のホワイトカラーの学歴の多くはフランス流に言うと「ＢＡＣ＋４」です。
フランスに「ＢＡＣ＋４」はないので「ＢＡＣ＋３」。
「フランス流」に言うと「Licence 」です。
「Licence 」が日本の一流企業、公務員、弁護士などの「 Educational background」です。
検察官や裁判官も「ＢＡＣ＋３」ですが、「法の理論」が「理解」できていません。
だから彼らは「第2部」で示す「適用する法律の誤り」をしています。
彼らは（BAC＋5）であるべきです。

フランスの場合です。
学士（BAC＋3）の場合、割と簡単な事務作業をさせられます。
修士（BAC＋5）の場合、将来の「幹部候補」として「マネジメント」の仕事をさせられます。

日本の文化で表現すると　「一般的な　キャリア」と「general office work」の違いといった感じです。
日本で大学卒業した者は　「一般的な　キャリア」として雇われます。
しかしフランスで、学士（BAC＋3）の場合は　「一般的な　キャリア」にはなれない。
学士（BAC＋3）の人は、ずっと「一般事務職」といった感じです。

日本のほとんどの企業は学士（BAC＋3）が経営しています。
（ただし、研究開発の技術系の社員や役員は「修士」や「博士」がいます）。
フランスは「超学歴社会」です。
私は、この学歴社会が「黄色いベスト運動」の原因だと思います。
フランスの「産業の競争力」が日本より弱いのは、フランスの「超学歴社会」にあると思います。
2002年にノーベル化学賞を受賞した「島津製作所」の「Tanaka koichiさん」は学士（BAC＋４）です。
日本の企業は、学歴による差別をしないのです。
日本の企業は「成果主義」です。

だから「ルノー」流に経営されると「日産」の社員は「仕事の意欲」を失います。
だから「日産」は潰れると、言ったのです。
「ＳＯＮＹ」という企業はご存知ですか。
第二次大戦後に創業した小さな会社でした。
ソニーの創業者である「Morita Akio氏」の「学歴は不用の理論」は有名です。
ソニーは「学歴」で差別をしないから、世界の「ＳＯＮＹ」になれたのです。
しかし今、「ＳＯＮＹ」は学歴を重視する社員や役員が多くなりました。
結果、「ＳＯＮＹ」も、成長がない「普通の会社」になりました。

この話は明日に続きます。

第2部。私は、2つのことを「訴えて」います。
これは日本政府による「国際的」な「人権侵害」です。
私たちの「honorの回復と賠償」が行われるように、皆様のご支援をお願いします。
世界が「法の下で統治」を無視するならテロで解決するのは当然です。しかし、クレイジーです。

１．外国人が「在留の資格」以外の「違法な労働」を行った。しかし外国人は無罪です。
外国人だけが入管法７０条「違法な労働の罪」で処罰されました。
これに対して入管法は不法な労働の「因果関係」である雇用者を入管法７３－２条
（不法な就労を助長した罪）で処罰しています。

しかし、日本の司法は外国人のみを「処罰」しましたが、「雇用者」を「処罰」していません。
これは明らかに「法の下での平等の原則」に反します
そして「恣意的」に外国人だけを「処罰」することを禁じた国際法に違反しています。

違法に外国人を雇用した雇用者が「無罪」であるならば、違法に働かされた外国人も「無罪」です。
そうであれば、入管法70条に対する「刑法の他の犯罪を支援した者」は誰もいません。
「私、KinGungaku、フィリッピン国の外交官、フィリッピン大使館職員」は無罪です。

２．検察が「入管法22-4-4条の支援」を理由として、
入管法70条に対して刑法の60条および62条の
「他の犯罪を支援する罪」を「適用」することは「クレイジー」です。
これは法の論理が狂っている。

外国人が入管法22-4-4条
（虚偽の書類を提出することによるstatus of residenceの取得）に規定する行為を行った。
しかし、これに対する「刑事処罰」はありません。
処分は、法務大臣による「status of residenceの取り消し」と「国外への強制退去」です。
したがって「刑法の60条および62条の「他の犯罪を支援する罪」は適用できません。
「起訴状」が指摘する入管法22-4-4条の「犯罪の理由」は入管法70条とは因果関係がない。
まったく、法の論理が狂っている。

日本政府は「告訴」を「crush」ています。
しかし国家権力による「crush」は「Statute of limitations」の「停止」です。

国会が承認した「条約」は国家として守る義務があります。
韓国の裁判所や日本の裁判所は、国会で制定した条約や法律を無視しています。
