１．私とKinGungakuが共謀して、内容が虚偽の雇用の契約書を中国人４人に提供した。
それで中国人４人は容易に「在留の資格」が取得できた。

２．中国人４人は容易に「在留の資格」が得られたので日本に「在留」できた。

３．中国人４人は「日本に在留」できたので「不法な労働」をすることが出来た。

４．よって検察は、私たちが入管法（資格外の活動による不法な就労）の違反を支援した犯罪であるとした。

検察は、私たちが中国人4人を雇用する「意志が無い」にも拘わらず、
中国人4人より「謝礼」を貰って「内容が虚偽の雇用の契約書」を作成し、
その契約書を中国人４人に渡した、と言います。

中国人4人が日本に在留できたので彼らは「不法な労働」をすることが出来た、と言うのは「論理」ではない。
中国人4人は、「不法な労働」（資格外の労働）をした罪で「起訴」されているのです。
不法に在留資格を取得して日本に在留していても、
法務大臣より取得した在留資格の範囲で就労すれば、「不法な労働」（資格外の労働）ではありません。

入管法は明確に規定しています。
虚偽の書類で在留資格を得たものは入管法22-4-4条違反です。
法務大臣より「在留の資格」が取消されます。
刑事処分はありません。
入管法22-4-4条違反に「刑法の他の犯罪を支援した罪」は適用できません。

「不法な労働」（資格外の労働）を「支援する罪」は
入管法73-2条（不法な労働を助長する罪）で規定されています。
処罰されるべきは、中国人4人を雇用しいた雇用者です。

私は、このことを「言い続けて」、もう8年です。

日本はＥＵのように「外国人労働者」の問題で国を二分してはいけない。

この事件は国際法違反です。各国において「批准した条約」は「各国の法律」よりも優先します。
条約違反を「指摘」することは「内政の干渉」ではありません。
世界は法の下で統治されるべきです。
