私もこの時の議論は読んだ覚えがあります。「海賊版の『購入者』にも法的な処罰（罰金、懲役等）を具体的に制定する」という案が出たものの結局見送りとなった件です。
但し、この時より前から既に「違法とされている商品を購入、所持する事」自体が法に反する行為であり、処罰制度があろうとなかろうと、それに変わりはない筈です。だから「買っても良いか」と言われれば当然「ＮＯ」です。
香港では最近ますます違法商品の取り締まりが厳しくなっており、市民の意識も以前とは比べ物にならないほど高くなってきています。まあ実際には、たとえ摘発現場に居合わせたとしても、税関（香港海関）職員は蜘蛛の子を散らすように逃げる業者を検挙するのにかかりっきりで一般人まで逮捕なんかしないだろうなとは思いますが、だからと言って、お奨めする事は到底出来ません。
以下は、97年12月にとある弁護士さんが、一般人向け法律相談コラム用に書いた文章です（校正の仕事で回って来たもので、無許可転載ではありません）

Q: I very often buy copy CD's and VCD's from the night markets around Hong Kong. I am breaking the law by buying such pirated products?
A: Yes and no. For all practical purposes however, you don't have very much to worry about if you do buy these copies - unless the current law is changed. There are in existence a myriad of laws which could be conceptually, arranged against a private citizen who buys or posses these pirate copies but it is a rare event indeed if a public or private prosecution is brought.
Obviously, I do not condone such participation in these unlawful activities but the question of the resolve of the authorities to stamp out such 'piracy' must be begged. One of the obvious ways to make this problem go away would be to criminalize all aspects of the trasaction - from copying and production, to sale and purchase. The argument goes that if the demand were reduced (most persons being law abiding citizens) the pirates would stop their copying activities. However, there is a jurisprudential point to be made as well as a Rights' issue at play. This runs as follows - should the might of society be arrayed against the whole of the community in order to protect the private interests of one sector of it. Arguably not, but the counter view is that, in reality, the entire law relating to theft is geared to towards protecting the rights of private property and that intellectual property piracy is simply that, no matter how the chain of participation in the process is arranged.
