放送の独立行政機関について内藤総務副大臣に提言します

日時：10月23日（金）午後４時から
場所：　参議院議員会館第6会議室

　私たち「開かれたＮＨＫをめざす全国連絡会」は、ＮＨＫの問題を中心に、日本のメディアのことを監視・批判・激励することを目的に市民・研究者・ジャーナリストなどが集まった団体です。

　このたび、民主党が提唱する「日本版ＦＣＣ」（通信・放送の独立行政委員会）について、その議論の参考としていただくように、私たちが考える独立行政機関の組織のあり方・作り方について、内藤正光総務副大臣（民主党参議院議員）に提言申し入れを行います。つきましては、上記のスケジュールでその内容を記者発表させていただきたく、ご案内する次第です。
　お忙しい中、急なご連絡で誠に恐縮ですが、多くの皆さんのご臨席を賜りますよう、お願い申し上げます。
　なお、提言の内容につきましては、記者会見の席上で発表させていただきたいと考えておりますので、よろしくご了承ください。

表現の自由をテーマにした初の日弁連人権大会シンポ、１１月５日午後、和歌山市民会館で

　１１月５日、和歌山市民会館で、表現の自由をテーマにした初の日弁連人権大会シンポジウムが開催される。これまでは、表現行為が生み出す弊害、すなわち、名誉棄損やプライバシー侵害をテーマにしたことはあるが、表現の自由をいかに保障し、情報の流通を促進するか、ということをテーマにしたことはなかった。

　きっかけは、昨年８月、日弁連人権擁護委員会内の精神的自由に関する部会の部会長経験者と某弁護士（笑）が、それぞれの危惧を話し合い、ビラまきに対する逮捕・起訴・最高裁有罪確定という流れと新たな表現手段であるインターネットへの規制強化の動き、規制の実績としてのがんじがらめのマスメディア法制について、テーマにした人権大会シンポジウムを開くべきだということで一致し、準備不足を分かりつつ、今年のテーマとして立候補することを部会、次いで委員会で提案、了承を得たうえ、最終的な選考会に臨んだ。例年シンポのテーマは３つ。今年に向けては４つのテーマが提案されたが、表現の自由は見事に（？）通過し、開催が決まった。

　開催決定後は、実行委員会のメンバーの献身的な努力で大会宣言、報告書（５００ページ近い）、シンポ本体の準備がどんどん整っていき、無事開催のめどが立った。準備不足との思いは常に頭の片隅にあったが、メンバーの努力がそのような危惧を吹き飛ばす結果を生んだと思う（まだ、終わっていないけど…）。

　報告書では、表現行為に対する制約を

１：市民が直接情報を発信する場面（ビラまき、デモなど）

２：市民が直接情報を入手する場面（情報公開）

３：市民が間接的に情報を入手する場面（マスメディア）

４：市民が新たに獲得した情報を直接受発信する場面（インターネット・パブリックアクセス）

という４つの場面に分けて、検討した。


　某弁護士（笑）は、このうち、３のチームに関わった。

　３のテーマについては、権力などからの独立性及び多様性を軸に据え、正面からマスメディアの限界を見据えつつ、その限界を突破するための提案を行っている。新しい問題では決してないが、独立性と多様性についてここまでの分析がなされた文献は、あまりなかったのではないかな～と思っている。マスメディア関係者のみならず、政治にかかわる市民＝すべての市民＝にぜひ、読んでほしい。


　シンポは、チラシに記載されたように、それぞれ一家言を持っている方々がパネリストとして登場し、午後いっぱい議論する予定だ。その中に、報告書を作成する過程で行った韓国視察などの成果がビジュアルに盛り込まれる。

　平日の昼間なので、出席しにくいかもしれないが、多くの方にご参加いただければと願っています。

To those who can hear me, I say: 'Do not despair.' The misery that is now upon us is but the passing of greed - the bitterness of men who fear the way of human progress. The hate of men will pass, and dictators die, and the power they took from the people will return to the people. And so long as men die, liberty will never perish.

Soldiers! Don't give yourselves to brutes - men who despise you and enslave you - who regiment your lives - tell you what to do - what to think and what to feel! Who drill you - diet you - treat you like cattle, use you as cannon fodder. Don't give yourselves to these unnatural men - machine men with machine minds and machine hearts! You are not machines! You are not cattle! You are men! You have the love of humanity in your hearts. You don't hate, only the unloved hate - the unloved and the unnatural!

Soldiers! Don't fight for slavery! Fight for liberty! In the seventeenth chapter of St Luke, it is written the kingdom of God is within man not one man nor a group of men, but in all men! In you! You, the people, have the power - the power to create machines. The power to create happiness! You, the people, have the power to make this life free and beautiful - to make this life a wonderful adventure. Then in the name of democracy - let us use that power - let us all unite. Let us fight for a new world - a decent world that will give men a chance to work - that will give youth a future and old age a security.

By the promise of these things, brutes have risen to power. But they lie! They do not fulfil that promise. They never will! Dictators free themselves but they enslave the people. Now let us fight to fulfil that promise! Let us fight to free the world - to do away with national barriers - to do away with greed, with hate and intolerance. Let us fight for a world of reason - a world where science and progress will lead to all men's happiness. Soldiers, in the name of democracy, let us all unite!

Hannah, can you hear me? Wherever you are, look up Hannah. The clouds are lifting! The sun is breaking through! We are coming out of the darkness into the light. We are coming into a new world - a kindlier world, where men will rise above their hate, their greed and their brutality. Look up, Hannah! The soul of man has been given wings and at last he is beginning to fly. He is flying into the rainbow - into the light of hope, into the future, the glorious future that belongs to you, to me, and to all of us. Look up, Hannah... look up!"
