本日のＥメール内容は、以下はとおりです。

前回、No：9の続きです。
正犯が、不法就労となった因果関係は、

資格外の職で働かせた事業者の不法行為です。
その処罰は、不法就労に対するほう助を含めた助長行為として同法７３の２条で処罰規定があるので、
一般法の刑法ほう助罪よりも優先されるもので、
刑法幇助罪の適用は法の論理に反します。
在留資格申請企業で働かない場合、
その外国人が不法就労や殺人などの犯罪行為をした際、
偽の雇用契約書を提供して日本におられるようにしたから、
犯罪行為をほう助したものであるとして、
犯罪とはなんら因果関係のないのに、刑法幇助罪を適用するのであれば、
我が国の入管行政は成り立たちません。
この事件で訴えているのは2つの誤りです
。
１．中国人やフィリッピン人が在留資格以外の働いたことは事実です、
この場合、働いたものと、働かせた者を平等に処分しなければなりませんが、
不法に働かせた者を、73条の２で何ら処分していません。
であれば、働かされた外国人は無罪です。
これが法の下での平等であり、国際法のルールです。
2．私やフィリッピン大使館職員などに対して、
内容虚偽の雇用契約書を提供したとして、
不法就労に対する刑法幇助罪を適用していますが、適用法誤りです。
虚偽の書類提出の幇助は、入管法の在留資格取消の幇助行為です。刑事処分は出来ません。
