「刑事訴訟法」第百八十九条、警察官は、それぞれ、
「他の法律」又は「国家公安委員会」若しくは「都道府県の「公安委員会」」の規定により、
「司法警察職員」として「職務」を行う。
「司法警察の職員」は、犯罪があると「推定」するときは、
「犯人=Offender」及び「証拠」を捜査するものとします。
と規定されています。
よって、犯罪が「推測」されない、
つまり、何も「法に違反していない」にも拘わらず、「捜査」、「逮捕」、「監禁」する、ことは、
「不法な行為」です。これは「特別公務員が職権を乱用する罪」にあたります。
警察官は不法な「内容が嘘偽の逮捕状」を「提示」した。
そして。被害者の「意思決定の自由」に圧力をかけて、「職務上の権限」を行使しています。
「特別公務員が職権を乱用する罪」は「故意」を必要としていません。
よって、この明らかな「不法な行為」は「職権の乱用」です。
よって犯罪は成立します。
