上記の場合は、「ステージ上で実際に使用したらこうなるだろう」という話の流れからwillになったんだと思います。

I. NONE OR ONE WORKING EXAMPLE
When considering the factors relating to a determination of non-enablement, if all the other factors point toward enablement, then the absence of working examples will not by itself render the invention non-enabled. In other words, lack of working examples or lack of evidence that the claimed invention works as described should never be the sole reason for rejecting the claimed invention on the grounds of lack of enablement.
未来形は英文明細書では極力避けるべきと思いますが、この例文では自然に感じられます。
しかしネイティブ同士でも意見が異なるかも知れませんね。
未来のことでありながら、未来形で表現すると自然な文章になるものと、そうでないものがあります。
「きょうは午後から晴れるでしょう」vs.「晴れます」
「おめめをさませば ごちそうするぞ」vs.「ごちそうするでしょう」
管理人さんの
「この靴を履いてステージで使用すれば」や「ステージ上で実際に使用したら」という考え方は、未だ実行していない時点(未来)の状況を的確に捉えており、ことさらに「固定されるだろう」とか「こうなるだろう」のように、二重に表現する必要はなく、「固定される」「こうなる」みたいにすれば十分ですね。
例えば、
The bolt head 48 will lie in recess 32 above said V-shaped slot guide 40, and the shoe will be stably positioned relative to the stage floors.
なら、この靴を履いてステージで使用すればボルトが凹部に嵌って靴が固定されるだろう、ということでwillも納得いくんですけどね。

富井篤著『技術翻訳のテクニック』(丸善)の180~181ページによれば、和文では表現するほどのことはないとしても、英文としては大事な"will"のようです。
他の解説書では、「この馬車は4人乗りだ」というときに"will"を使っていたように思います。
