今日から裁判員制度が今日から実施されるのにちなみ裁判ジョークを紹介します。

殺人などの重罪をおこした人間が、数年から終身の間ムショ（無償の駄洒落です）で食事付、病気にかかれば医者に診てもらえる生活をしているのに世の中には住むところもない、医者にも診てもらえないホームレスが大勢いるという矛盾を思い起こさせるジョークです。
以前 "rough-and-ready"(http://blog.alc.co.jp/blog/3302827/142928) の表現が裁判員制度（lay judges system）の記事にあった事を書きましたがその裁判員制度がいよいよ始まります。
法律に疎い私には知らないことや疑問がいっぱいあります。 例えば、執行猶予（probation/a suspended sentence）の規準は甘過ぎやしないか、あるいは死刑判決を受けた受刑者が何年も執行されずにいるのは何故、等々。 罪に対する罰（執行猶予や刑の執行も含め）も当然法律に基づき決まっているのであれば法律の専門家である裁判官の判断にまかせるだけで良いはずだが、素人を参加させる裁判員制度の意味は何か？
裁判に参加する素人が（法律に疑問を感じている場合には）法律とは別の判断をすることを期待、あるいは許容するのが意図なのでしょうか？ 裁判員制度施行についてマスメディアは騒いでいる割には、肝心な何故裁判員制度を施行するのか、その目的についての言及が少ない（私は聞いた事がない）のは不思議です。
