日の丸・君が代を教師に義務づけた東京都教委の通達と校長の職務命令は違法ー東京地裁がそんな判断を示した。
The Tokyo Metropolitan government board of education's notification and school principlas' duty orders which obliged the school teachers to pay respects to the Japanese national flag and national anthem are illegal. This is a ruling issued by the Tokyo District Court.
(The Tokyo District Court on Thursday ruled that a notice issued by the Tokyo metropolitan government's education board and orders from school principals obliging teachers to stand when the Hinomaru national flag is raised and sing the national anthem,"Kimigayo," atschool events are illegal.)

教師には、そうした通達・命令に従う義務はない、国旗に向かって起立しなかったり、国歌を斉唱しなかったとしても、処分されるべきではない、と判決は言う。
The ruling sates that the teachers are not obliged to comply with these notifications and duty orders,and should not be punished even if they don't satnd up for the national flag and don't sing the national anthem in unison.
(The ruling means that teachers are not obliged to obey the notice and orders,and that they cannot be punished for not complying.)

Incumbent and former teachers of Tokyo prefectural high schools and handicapped-children schools have filed a legal suit,insisting that the enforcement of the Rising Sun Flag and the Anthem of His Majesty' Reign was breach of humans' thought and conscience.
