◎メルシエ将軍、軍法会議で偽証（１８９５）
昨日の続きである。英語研究雑誌『青年』の第二巻第一一号（一八九九年一二月）に載っている英文「ドレフュス事件」（THE DREYFUS CASE）を紹介している。昨日は、「Ⅰ.」を紹介したが、本日は、「Ⅱ.」を紹介する。
昨日と同様、英文、その拙訳、『青年』誌による註の順に紹介する。英語の原文に、若干、史実とことなる部分があるようだが、注記や訂正はしていない。
Ⅱ.
In December the court martial took place. Lieutenant-Colonel du Paty de Clam, Colonel Henry and various experts testified that the bordereau was in Dreyfus's handwriting; but other experts disagreed. The case against Dreyfus looked shaky.
Then in secret session, without the knowledge of either the prisoner or his councel, General Mercier, the minister of war, read the judges a simple sentence from a cipher letter that he said had come into possession of the ministry. "Dccidedly," he quoted, "this scoundrel of a Dreyfus is becoming too exacting."
The minister of war, like some othor witnesses, perjured himself. It has since been shown that the name " Dreyfus " did not occur in the letter he pretended to read, and that the letter was not even remotely connected with the alleged selling of army secrets to the Germans.
But the pejury swayed the court martial, already influenced by the anti-Semite crusade which was then waging in France. Dreyfus was sentenced to military degradution and imprisonment for life.
How tho first part of the sentence was carried out has been briefly told. In February, 1895, forbidden even to bid farewell to his wife and children, Dreyfus was deported to the Ile du Diabte,―"Devil's Island,"―a pestilential place off the coast of French Guiana; and here he remained for more than four years, shut up in a high stockade that enclosed an iron hut, forbidden to speak, watched contiually by armed guards, chained to his bed at night, not permitted even to receive hie wife's letters until they had been so rewritten, the order of the sentences so altered, as to make secret communication itnpossible.
To a man of thirty-five, wbo had been rich, ambitious, happy in his family life, the years that stretched away before him might have seemed to promise worse things than death; but Dreyfue, it seems, did not despair. His wife believed in him and was working for him; and although he did not know it, an important step toward his vindication was taken in the spring of 1896, when Lieutenant-Colonel Picquart succeeded Colonel Sandherr at the head of the French army's " intelligence department," the spy bureau.
その二
〔一八九五年〕一二月、軍法会議（court martial）が開かれた。デュ・パティ・ド・クラン陸軍中佐、アンリ大佐、そして様々な鑑定人が、「明細書」の筆跡は、ドレフューのものであると証言した。しかし、それを否定する鑑定人もいた。ドレフューに対する申し立ては、根拠が薄弱のように見えた。
その後、裁判は秘密会（secret session）となり、被告も弁護士も知らないうちに、陸軍大臣（the minister of war）のメルシエ将軍が、裁判官に対し、ひとつの暗号書状（a cipher letter）から、ある一文を読みあげた。将軍によれば、その書状は、陸軍省で入手したものだという。将軍が引用したのは、「たしかに、ドレフューという悪党は、あまりに増長してきた」という一文である。
陸軍大臣は、他の数人の証人たち（some othor witnesses）と同じく、偽証をおこなったのである（perjured himself）。すなわち、その書状には、「ドレフュー」という名前は、存在しなかったにもかかわらず、将軍は、これを偽って読んだのである。また、この書状は、ドイツ人に軍機を売った疑いとは、ほとんど何の関係もないものだったのである。
しかし、この偽証（pejury）が、軍法会議を左右した。軍法会議は、当時、フランスで展開されていた反ユダヤ主義運動（the anti-Semite crusade）の影響を、すでに受けていた。ドレフューは、軍事上の屈辱（military degradution）、および終身禁錮（imprisonment for life）の刑を宣告された（was sentenced）。
処罰の一部が、どのように執行されたかについては、すでに短く述べた〔その一の「位階剝奪式」〕。一八九五年二月、ドレフューは、妻子に別れを告げることも許されないまま、ディアブル島（Ile du Diable）、すなわち「悪魔の島」（Devil's Island）に流された。その島は、フランス領ガイアナの沖にあり、瘴癘の地（a pestilential place）であった。高い柵に取り囲まれた鉄製の小屋に、ドレフューは四か年とどまった。話すことを禁じられ、常に武装した監視員に見張られた。就寝時は、足かせでベッドにつながれた。妻からの手紙も、そのまま、受け取ることはできなかった。秘密の通信を防ぐため、手紙は、文章の順序を入れ替え、書き直されたものが手渡された。
かつて裕福に暮らし、大望を抱き、幸せな家庭生活を送っていた三十五歳の男にとって、自分の前に伸びている年月は、死よりもつらいものと思えたことであろう。しかし、ドレフューは、絶望しなかったように見える。彼の妻は、夫を信じており、夫のために努力を続けていた。もちろん、ドレフューは、知るよしもなかったが、彼の無実を証明する上で、ひとつの重要な一歩が生じた。それは、一八九六年の春のことで、このとき、ピカール中佐（Lieutenant-Colonel Picquart）が、サンデール大佐（Colonel Sandherr）の後任として、フランス陸軍情報部諜報局長となるということがあったのである。
